Terms and Conditions of Sale

Article 1 - Purpose

These Terms and Conditions of Sale (T&C) govern the contractual relationship between EMETH and its customers in connection with product sales made on the website emethofficial.com. They apply exclusively to consumers, i.e. any individual acting for purposes that fall outside the scope of their commercial, industrial, craft or professional activity.

Article 2 - Products

EMETH sells premium-quality clothing and accessories, made to order using the print-on-demand technique. Products are described as accurately as possible on the site, particularly with regard to their characteristics, images and prices.

Photographs illustrating the products are not contractually binding and may show slight variations from the actual product, particularly in terms of colors due to your screen's display settings.

Article 3 - Prices

Product prices are shown in euros, all taxes included. French VAT is applied at the legal rate in force. Shipping costs are calculated based on the weight of the order and the destination, and are clearly shown before the order is finally confirmed.

EMETH reserves the right to change its prices at any time, it being understood that the price shown in the catalog at the time of the order will be the only price applicable to the customer. Promotional offers and discount codes are valid for a limited time and while stocks last.

Article 4 - Orders

Placing an order takes place in several steps:

  1. Selecting products and adding them to the cart
  2. Reviewing the cart contents and applying a promo code if applicable
  3. Entering shipping and billing information
  4. Choosing the shipping method
  5. Secure payment of the order
  6. Order confirmation by email

Once the order is confirmed and paid for, a confirmation email is sent to the customer within 24 hours. This email serves as proof of purchase and contains a summary of the order along with its tracking number.

Article 5 - Shipping

Products are delivered to the address provided by the customer when placing the order. Delivery times are as follows:

France

5-10 business days

European Union

7-13 business days

Switzerland

8-15 business days

International

12-20 business days

These are total lead times: they include made-to-order production (2 to 5 business days) and transit. Shipping is free from €100 of purchase. A tracking number is sent by email as soon as the package is shipped.

Article 6 - Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify any reason or pay any penalty (excluding return shipping costs).

To exercise this right, the customer must:

  • •Send an email to contact@emethofficial.com within the 14-day period
  • •Return the products in their original condition, unworn, unwashed, with tags
  • •Include the duly completed return form

Return shipping costs are borne by the customer, except for mainland France where they are free. The refund is issued within 5-7 business days after receipt and validation of the return.

Article 7 - Payment

Payment is made by credit card (Visa, Mastercard, American Express) via the secure Stripe platform. Transactions are encrypted and comply with PCI DSS security standards.

The card is charged when the order is shipped. In the event of payment refusal, the order will be canceled and the customer will be notified by email.

Article 8 - Legal warranties

All products automatically benefit, at no extra cost and independently of the right of withdrawal, from:

Legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code)

In the event of non-conformity, the customer has a period of 2 years from delivery of the goods to take action. They may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L.217-9.

Legal warranty against hidden defects (Article 1641 of the French Civil Code)

In the event of a hidden defect, the customer may obtain a refund of the price or a price reduction if they keep the goods. The time limit for taking action is 2 years from discovery of the defect.

Article 9 - Liability

EMETH cannot be held liable for inconveniences or damage inherent to the use of the Internet, in particular a service interruption, external intrusion or the presence of computer viruses.

EMETH cannot be held liable for damage resulting from improper use of the products purchased. The customer is solely responsible for how they use the products after delivery.

Article 10 - Governing law and jurisdiction

These T&C are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, the French courts shall have sole jurisdiction.
